Terms of Service for Campsites (B2B)
The Terms and Conditions were last updated on December 28, 2024
1) Scope
CampList ("CampList.gr" or "we" etc.) mediates information and services related to the recreational activities of individuals seeking a campsite for a specific date or period ("camper"). The services provided by CampList.gr are available to campers for private and non-commercial use. The B2C General Terms and Conditions apply between campers and CampList.gr. CampList.gr provides providers of campsites, parking spaces, tent sites ("campsites") and other commercial providers ("campsite operators" or "users") the ability to use the online marketplace and portal we operate through www. CampList.gr, (hereinafter collectively referred to as: "market") in accordance with the B2B General Terms and Conditions set out herein. Unless expressly excluded, all services provided by CampList.gr to the campsite operator are provided exclusively on the basis of these B2B General Terms and Conditions - this applies regardless of the way (e.g. via the internet, all types of mobile devices, via email, in writing or by telephone) in which they are provided and/or agreed upon, either directly or indirectly (e.g. via third parties). Provisions that differ from these Terms and Conditions are only valid if CampList.gr has acknowledged them in writing or in text form. By requesting access as defined in section 3, the campsite operator acknowledges that these B2B General Terms and Conditions are a binding element of the existing contract with CampList.gr. CampList.gr will inform the campsite operator of changes to these Terms and Conditions in writing or in text form. If the campsite operator does not object to such changes within six weeks of receipt of the notification, the changes shall be deemed to have been agreed. In the event of changes to the Terms and Conditions, the campsite operator shall be separately informed of his right to object and of the legal consequences of his silence.
2) Nature and scope of our services
The marketplace is a platform for campers and providers of campsites, car parks, parking lots and related services. The marketplace is equipped with a comprehensive, automated notification system to simplify communication between campers and campsite operators.
3) Access to the marketplace and marketplace account
The campsite operator is responsible for ensuring that the information it provides - in particular in the context of the access request - to CampList.gr and other users is true and complete. It undertakes to notify CampList.gr of all future changes to the information provided without delay. CampList.gr has the right to delete a campsite operator or block access to the marketplace if there are sufficient suspicions that it has violated the terms of use set out herein. The campsite operator can prevent these measures by dispelling these suspicions by providing appropriate evidence at his own expense. All connections are personalized and can only be used by the respective authorized user. Actions and statements of intent using the respective connection of a user must be attributed to the said user. The user undertakes to ensure that the connection and password remain secret and to protect them from access by unauthorized third parties. The campsite operator is also responsible for the confidentiality of the connections of its employees and must inform its employees accordingly. In case of suspicion of misuse by third parties, the user must inform CampList.gr without delay. As soon as CampList.gr becomes aware of the unauthorized use, CampList.gr deactivates the account of the unauthorized user. We reserve the right to change a user's login and password - in such cases, we inform the campsite manager without delay.
4) Obligations of the campsite operator
The campsite operator must ensure that the information it provides to the marketplace is correct and truthful and that it does not infringe the rights of third parties. In particular, the services it provides must be described accurately and completely in words, images and/or videos. The description of the property as well as the images and videos used for this purpose must refer only to the services offered. The campsite operator is responsible for ensuring that its offers and content (in particular images and other information) are correct and do not infringe the rights of third parties. It is prohibited to offer or advertise goods or services on the marketplace that infringe the rights of third parties, legal provisions or good morals, as well as to upload copyrighted material to the marketplace without the appropriate permits. Services that can only be offered with a certificate provided for by law can only be offered and requested on the market if this certificate has been included in the description of the goods or services and the good or service is provided/offered only with this certificate, as provided for by law. Campsite operators who offer goods or services to consumers in the context of their commercial or self-employed professional activities are obliged to provide them with the information on consumer protection specified by law and to inform them of the existence or non-existence of any legal right of withdrawal. Campsite operators are allowed to use the personal data they have received through the use of the services of CampList.gr only for the specified or obvious purposes of communicating and fulfilling the contract with the data subject. In particular, it is prohibited to sell this data to third parties or to use it for sending advertisements, unless the data subject has given explicit prior consent for this purpose in accordance with applicable legal provisions. In addition, the campsite operator is also responsible for: • to inform CampList.gr without delay of any technical changes that occur within its scope. • functions if they are capable of affecting the provision of services or the security of the marketplace, • is obliged to cooperate, where necessary, in investigations into third-party attacks on the marketplace, • to carry out business transactions on the marketplace only in the context of commercial business activities for commercial purposes, • to refrain from any measure that endangers or disrupts the functioning of the marketplace, as well as not to gain access to data for which it is not authorized. The campsite operator is obliged to compensate CampList.gr for all damages resulting from the culpable failure to comply with these obligations on his part. The campsite operator will also indemnify CampList.gr against all claims that third parties may raise against CampList.gr due to a violation of their rights or due to a violation of rights due to the offers and/or content posted by the campsite operator, if and to the extent that the campsite operator is at fault for this. The campsite operator also undertakes to bear the costs of the legal defense of CampList.gr, including all court and attorney's fees in this matter.
5) Intellectual property/rights of use
The information, images, videos and offers (hereinafter collectively referred to as "content") on the marketplace, the campsite operator hereby grants to CampList.gr a worldwide, non-exclusive, irrevocable, perpetual, transferable and royalty-free (the license) with the right to sublicense, to use, process, disseminate and transmit the content, as well as to make it available to the public. In addition, the campsite operator grants to CampList.gr the right (the license) to market, advertise, display, incorporate and use the content it uploads to the marketplace. This applies not only to the marketplace itself, but also to commercial promotion that goes beyond the scope of the marketplace itself (on the Internet, in social networks, newsletters, etc.) and for email advertising purposes. CampList.gr conducts the online campaigns and marketing campaigns at its own expense and at its own discretion. This right may be revoked or restricted by the beneficiaries at any time with effect for the future by submitting a written statement to CampList.gr. Without limiting the provisions of these General Terms and Conditions, the campsite operator acknowledges and agrees that the marketplace as well as its content are protected by copyright, trademarks, database rights and other laws. The campsite operator undertakes to refrain from and prevent (within the scope of its responsibility) any form of use that infringes these or other intellectual property rights of CampList.gr, service providers assigned by CampList.gr and distribution partners or third parties.
6) Data security and privacy policy
The servers of CampList.gr are secured according to the latest technology, in particular by means of firewalls - however, the user is aware that all parties are exposed to the risk of interception of transmitted data during transmission. This applies not only to the exchange of information via electronic messages leaving the system, but also to integrated messaging systems, as well as to all other data transmissions. Therefore, the confidentiality of the data transmitted in connection with the use of the marketplace cannot be fully guaranteed. By authorizing access, the campsite operator provides CampList.gr and all other users with the guarantee that the data transmitted by the campsite operator complies with data protection requirements (in particular, but not exhaustively, with the EU GDPR). The campsite operator also indemnifies CampList.gr against all third-party claims, including those arising from public law. In particular, the campsite operator itself must ensure that the necessary declarations of consent are obtained from employees before uploading their personal data to the marketplace in the context of configuring employee connections or in any other way. The campsite operator acknowledges that, with regard to the campers whose personal data is transmitted to it, it is considered a controller, as defined in the EU GDPR. In addition, the campsite operator acknowledges the privacy policy of CampList.gr and undertakes to ensure that the provisions of said policy are complied with.
7) Assignment of rights
The partial or full transfer of the rights of the campsite operator from the contract with CampList.gr to third parties is prohibited.
8) Duration of the contract
The contract, which is subject to these General Terms and Conditions, is concluded for an indefinite period. It begins with the approval of the license by CampList.gr. The contract can be terminated by both parties at the end of each month with a three-month notice. Each party has the right to terminate the contract for good cause without notice. In particular, the following constitute grounds for CampList.gr: • Violation of the provisions of these General Terms and Conditions by the campsite operator, which is not remedied even after a grace period, • Unjustified actions on the part of a user or attempted such actions, e.g. fraud, • The campsite operator is more than six weeks late and must make a payment to CampList.gr. • or the partner of a contract mediated by CampList.gr, • Continuous operational disruptions as a result of force majeure that is beyond the control of • CampList.gr, such as natural disasters, fires, or the collapse of distribution networks for which there are no Each complaint must be made in text form. 9) Final provisions

In the event that individual provisions of these general terms of use are or become unenforceable and/or conflict with statutory provisions, this shall not affect the enforceability of the remaining terms of use. The unenforceable provision shall be replaced, by mutual agreement of the contracting parties, by a provision that more closely approximates the economic purpose of the unenforceable provision in a legally enforceable manner.
